1. cadre de réalisationL'Artiste s'accorde a créer une œuvre digitale (la "Commission") fondé sur cette option Ko-Fi, ainsi que le personnage, le concept, ou l'idée fournie par le Client. Le résultat final sera rendu sous format digital sauf indication contraire. (Les Badges et Stickers commissionnés seront rendues sous forme d'objet physique).

2.PayementLe Client s'accorde a payer l'entierté du montant (MONTANT DÛ DANS LA DEVISE CONVENUE) de la Commission. Le paiement a valeur d'acceptation par le Client des conditions générales et lui confère la licence comme décrite ci-dessous.

3.Licenses & Droits d'UsageEn payant pour cette illustration, le Client achète une licence a usage personnel de l'œuvre commissionée. Cette licence inclus les droits détaillés ci-dessous :•Le Client peut partager, poster, afficher l'œuvre en ligne, ou en privé. sauf accord contraire.•Le Client peut utiliser l'œuvre en tant que référence pour ses propres personnages ou project creatifs personels,si iel seul possède le personnages/l'idée, mais non l'œuvre produite par l'artiste.Cependant le Client n'as PAS LE DROIT de :•Vendre, redistribuer, ou tirer profit financier de cette œuvre en particulier. sauf accord contraire.•Créer, ou vendre de la marchandise (Prints, vêtements, stickers) faisant usage de cette illustration. sauf accord contraire.•UTILISER CETTE ŒUVRE, DANS DES IAs GÉNÉRATIVE POUR L'APPRENTISSAGE AUTOMATIQUE D'IAs, Y COMPRIS, SANS S'Y LIMITER, CHATGPT, GEMINI, MIDJOURNEY, DALL.E, GROK OU TOUT AUTRE SYSTÈME SIMILAIRE.•Revendiquez la paternité de l'œuvre. Tous les droits non expressément accordés restent la propriété de l'Artiste.

4. Droits d'AuteurL'Artiste conserve l'intégralité des droits d'auteur et des droits moraux sur l'œuvre.
L'achat effectué par le Client ne lui confère que les droits d'utilisation décrits précédemment ci-dessus.
Si le Client souhaite utiliser l'œuvre à des fins commerciales, un accord écrit distinct et le paiement de droits de licence seront nécessaires.

5. Retouches et livraisonÀ moins d'accord préalable, l'Artiste produira jusqu'à 4-5 modification mineurs avant de facturer tout supplément. L'illustration finale sera livrée selon le mode de livraison choisi, dans un délai maximum de trois semaines à compter du paiement ou de la validation de l'esquisse, sauf accord contraire.

6. Remboursement et annulationUne fois la Commission passée, aucun remboursement ne sera effectué, sauf si l'Artiste se trouve dans l'impossibilité de mener à bien la commande pour des raisons personnelles ou imprévues ; dans ce cas, un remboursement partiel ou intégral pourra être accordé, à la discrétion de l'Artiste.

7. AccordEn effectuant le paiement, le Client reconnaît avoir lu, compris et accepté les conditions générales.

1. Scope of WorkThe Artist agrees to create a custom digital artwork (the "Commission") based on the option agreed on , and the Client's provided character, concept, or prompt. The final piece will be delivered in a digital format unless otherwise agreed. (Commissioned badge(s) and sticker(s) will be delivered as physical item)

2. PaymentThe Client agrees to pay the total amount of (AMOUNT OF MONEY OWED IN CURRENCY YOU AGREED ON) for the Commission. Payment confirms the Client's agreement to the terms and conditions and grants the license described below.

3.Licensing & Usage RightsBy paying for this drawing, the Client is purchasing a personal-use license to the commissioned artwork. This license includes the following rights:The Client may share, post, and display the artwork online or in personal space
The Client may use it as a reference for their own characters or creative spaces. projects, as they own the character/prompt, but not the artwork itself.However, the Client MAY NOT:Sell, redistribute, or otherwise profit directly from this specific artwork.Create or sell merchandise (prints, apparels, stickers) using this artwork.USE THIS ARTWORK IN ANY GENERATIVE AI, IMAGE AI, OR MACHINE LEARNING DATASETS, INCLUDING BUT NOT LIMITED TO CHATGPT, GEMINI, MIDJOURNEY, DALL.E, GROK, OR SIMILAR SYSTEMS.Claim authorship of the artwork. All rights not expressly granted remain with the Artist.

4. CopyrightThe Artist retains full copyright and moral rights to the artwork.
The Client's purchase grants usage rights only as described above.
If the Client wishes to use the artwork for commercial purposes, a separate, written agreement and licensing fee will be required.

5. Revisions and DeliveryUnless otherwise agreed, the Artist will provide 4-5 rounds of minor revisions before charging for more.The final artwork will be delivered by preferred method, within time agreed on payment or sketch approval.

6. Refunds and CancellationsOnce the commission has been purchased, no refunds will be issued except if the Artist is unable to complete the commission for personal or unforeseen reasons; in this case a partial or full refund may be provided at the Artist's discretion.

7. AgreementBy submitting payment, the Client acknowledges that they have read, understood, and agreed to the terms and condition.
